TNS MOTION STUDIO – TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your access to and use of TNS Motion Studio’s website, products, and creative services. By using our site or engaging our studio, you agree to be legally bound by these Terms.

 

  1. Services Provided

TNS Motion Studio offers:

  • Video production
  • Photography
  • Editing and post-production
  • Casting services
  • Creative consulting
  • Branding and media-related services

Specific deliverables will be defined in individual project agreements, invoices, or statements of work.

 

  1. Client Responsibilities

Clients agree to:

  • Provide accurate information
  • Supply all necessary assets (scripts, logos, footage, etc.) on time
  • Secure all required permissions, releases, licenses, and access rights for locations, talent, and materials
  • Act professionally during shoots and collaborative work

Failure to provide materials or cooperation may result in project delays or additional costs.

 

  1. Booking, Payments, and Deposits
  • All bookings require a non-refundable deposit unless otherwise negotiated.
  • Failure to pay deposits or invoices may result in service suspension.
  • Payments for services are due by the date stated on the invoice.
  • Late payments may incur additional fees.

 

  1. Cancellations and Rescheduling
  • Cancellations made within 48 hours of a scheduled shoot may incur a cancellation fee.
  • Weather-related or unavoidable circumstances will be handled case-by-case.
  • Rescheduling is allowed subject to availability.

 

  1. Ownership & Intellectual Property

5.1 Client Materials

You retain ownership of all materials you provide. By submitting assets, you grant TNS a complete license to use them for their projects.

5.2 TNS Work Product

Unless otherwise agreed in writing:

  • TNS retains ownership of raw footage, project files, drafts, and working materials.
  • The client is granted a license to use final delivered content for the purposes specified in the project agreement (commercial, personal, or promotional use).

5.3 Portfolio Use

TNS may display completed works in its portfolio, reels, website, and social platforms unless the client requests confidentiality in writing before the project begins.

 

  1. Prohibited Use

Clients may not:

  • Misuse studio content for unlawful purposes
  • Modify or resell TNS materials without permission
  • Attempt to reverse engineer or access backend systems
  • Upload harmful, offensive, or copyrighted material without permission

 

  1. Limitation of Liability

To the fullest extent permitted by law:

  • TNS is not liable for indirect, incidental, or consequential damages.
  • Our total liability for any claim will not exceed the total amount paid for the specific project giving rise to the claim.
  • TNS is not responsible for delays caused by technical failures, weather, shipping issues, or client inaction.

 

  1. Indemnification

You agree to indemnify and hold TNS harmless from all claims, damages, losses, or expenses arising from:

  • Your misuse of content
  • Your failure to obtain necessary rights or releases
  • Your breach of these Terms

 

  1. Termination

TNS may suspend or terminate services if:

  • You fail to pay fees
  • You violate these Terms
  • You engage in abusive or unlawful behaviour

Upon termination, all outstanding balances become immediately due.

 

  1. Governing Law

These Terms are governed by the laws of the Province of Nova Scotia, Canada.
Any disputes will be resolved exclusively in the courts of Nova Scotia.

 

  1. Changes to Terms

TNS may update these Terms at any time. Continued use of our site or services constitutes acceptance of the revised Terms.
